Terms and Conditions

These Terms and Conditions govern the use of the Boatique Charters website and the booking of yacht charters, liveaboard trips, and related services arranged by Boatique Charters (“Boatique”, “we”, “us”, or “our”).

By using our website, submitting an enquiry, paying a deposit, or confirming a booking through us, you agree to these Terms and Conditions.

Our Role

Boatique Charters acts as a charter specialist, booking intermediary, and advisor for private yacht charters and related travel services in Indonesia.

Where Boatique is not the direct operator of the vessel, the charter or travel agreement is made directly between you and the vessel owner, operator, or service provider (“Provider”). In those cases, Boatique is responsible for arranging and managing the booking process, but is not the party operating the yacht, crew, itinerary, or onboard services.

Where Boatique directly owns or operates a vessel, Boatique may act as both booking party and Provider. In such cases, this will be made clear during the booking process or in your booking confirmation.

Booking Requests and Confirmation

All bookings are subject to availability and are not confirmed until you receive written confirmation from Boatique.

A booking request does not constitute a confirmed reservation. You should not make any connected travel arrangements, including flights, hotel stays, or onward transport, until your booking has been confirmed in writing.

Boatique may require additional information before confirming a booking, including but not limited to passport details, guest names, dietary requirements, diving certifications, insurance details, medical declarations, or arrival and departure information.

Quotes and Pricing

All quotations are subject to availability at the time of confirmation.

Unless stated otherwise in writing, all pricing is provided in the currency specified in your quotation or invoice. Prices shown in other currencies are for reference only and may vary depending on exchange rates and payment provider charges.

Quoted prices may exclude items such as:

  • park and harbour fees

  • fuel surcharges

  • alcoholic beverages

  • crew gratuities

  • rental equipment

  • specialist activities or training

  • domestic or international flights

  • hotels before or after the charter

  • visas, taxes, or local government charges

Inclusions and exclusions will be clearly outlined in your proposal, invoice, or booking confirmation.

Deposits and Payment Terms

A deposit is required to secure a booking. Unless otherwise stated in writing, the standard deposit is 30% of the total charter value.

The deposit must be paid within the timeframe stated on the invoice. If payment is not received within that period, the booking may be released without further notice.

The remaining balance is typically due 60 days before departure, unless a different payment schedule applies to the Provider or specific charter. For bookings made within 60 days of departure, full payment may be required at the time of confirmation.

If full payment is not received by the due date, Boatique reserves the right, or may be required by the Provider, to cancel the booking and apply the applicable cancellation terms.

Payment Methods

Payments may be made by bank transfer, card payment, or other methods approved by Boatique.

Bank transfer fees, currency conversion charges, payment gateway fees, card surcharges, and charges arising from incorrect payment instructions remain the responsibility of the guest unless otherwise agreed in writing.

Any refund will be made in the same currency as the original payment where reasonably possible.

Provider Terms

Each vessel and Provider may have its own booking, payment, amendment, operational, and cancellation terms.

By confirming a booking through Boatique, you also agree to the specific Provider terms applicable to that charter. Where there is any conflict between these Terms and the Provider’s operational or cancellation terms, the Provider’s charter-specific terms will apply to the operation of the trip, unless local law requires otherwise.

Boatique will provide the relevant Provider terms, booking conditions, or charter summary during the booking process where applicable.

Changes and Amendments by Guest

If you wish to change your booking in any way, including travel dates, guest names, cabin arrangements, or charter details, you must notify Boatique in writing.

All requested changes are subject to availability and approval by the Provider. Additional costs may apply.

Changes made close to departure may be treated as a cancellation and rebooking, depending on the Provider’s terms.

Where permitted, one guest may be substituted for another before departure, provided sufficient notice is given and all required documentation is supplied. Any substitution remains subject to Provider approval.

Cancellation by Guest

All cancellations must be made in writing.

Unless different Provider-specific terms apply, the following standard cancellation terms apply:

  • Deposit payments are non-refundable once a booking is confirmed.

  • If cancellation is made more than 90 days before departure, Boatique may, at its discretion and subject to Provider approval, assist in transferring the booking value or deposit to a future departure. This is not guaranteed.

  • If cancellation is made 60 days or less before departure, up to 100% of the total booking value may be charged.

  • Where the Provider’s cancellation terms are stricter than the above, those terms will apply and will be communicated during the booking process.

If any refund is approved, Boatique may deduct unrecoverable banking, card processing, currency conversion, administration, or third-party handling costs.

Cancellation or Changes by Provider

Yacht charters are subject to operational realities, including weather, sea conditions, local regulations, technical issues, crew availability, harbour restrictions, safety concerns, and government requirements.

The Provider reserves the right to amend routes, timings, itineraries, activities, embarkation points, or onboard services where reasonably necessary for safety, operational, environmental, or legal reasons.

Where the Provider replaces a vessel with another vessel of a similar standard, this shall not automatically entitle the guest to a refund, provided the substitute is reasonably comparable.

If a charter is cancelled by the Provider, Boatique will use reasonable efforts to assist in securing an alternative vessel, revised dates, credit, or refund in line with the Provider’s terms. Boatique is not responsible for losses arising from the Provider’s cancellation beyond any amount actually recovered from the Provider and passed on where due.

Force Majeure

Neither Boatique nor the Provider shall be liable for delay, cancellation, amendment, loss, or failure in performance caused by events beyond reasonable control, including but not limited to:

  • severe weather or sea conditions

  • natural disasters

  • pandemics or public health events

  • war, civil unrest, terrorism, or political instability

  • port closures

  • government restrictions

  • strikes

  • fuel shortages

  • technical or navigational safety issues

  • acts or omissions of third-party transport providers

In such circumstances, refunds, credits, or rebooking options will depend on the Provider’s terms, insurance coverage, and what sums can be recovered from third parties.

Guest Responsibilities

You are responsible for ensuring that all guests:

  • hold valid passports, visas, and travel documents

  • meet health, vaccination, and entry requirements

  • arrive at the agreed meeting point on time

  • comply with all Provider rules and onboard safety instructions

  • hold any required diving certifications or experience for dive-related itineraries

  • disclose relevant medical conditions, mobility requirements, disabilities, allergies, or dietary restrictions in advance

  • provide accurate guest information when requested

Boatique may assist with planning advice, but it remains your responsibility to ensure all guests are fit and prepared for travel.

Missed Departure and No-Show

If you or any guest fail to arrive at the agreed meeting point on time, the charter may depart without you.

In such cases, the booking may be treated as a no-show or last-minute cancellation, and no refund will be due unless the Provider agrees otherwise.

Any costs related to catching up with the yacht, alternative transfers, accommodation, or revised arrangements remain the responsibility of the guest.

Insurance

Comprehensive travel insurance is strongly recommended for all guests and may be mandatory for certain charters or diving itineraries.

Where diving or remote travel is involved, guests should ensure that their insurance covers:

  • trip cancellation

  • medical treatment

  • emergency evacuation

  • diving activities

  • baggage and personal belongings

  • charter interruption or curtailment

Boatique does not provide insurance and is not responsible for losses resulting from insufficient or absent insurance cover.

Diving, Activities, and Safety

Participation in diving, snorkelling, watersports, trekking, tender excursions, or other activities is at the guest’s own risk and remains subject to weather, local conditions, safety briefings, certification, health status, and the judgment of the captain, cruise director, dive team, or Provider.

The Provider reserves the right to refuse participation in any activity where it believes doing so is necessary for safety, legal, medical, or operational reasons.

Special Requests

Any special request, including dietary needs, bed configuration, child arrangements, onboard celebrations, activity requests, or equipment hire, must be submitted in writing.

Boatique will pass such requests to the Provider, but cannot guarantee they will be available unless confirmed in writing. Unless specifically agreed as part of the booking confirmation, special requests do not form part of the contract.

Liability

Where Boatique acts as an intermediary, Boatique is not liable for the acts, errors, omissions, insolvency, negligence, or failures of any Provider, vessel owner, captain, crew, hotel, airline, transfer company, dive operator, or other third party.

Boatique is not liable for:

  • injury, illness, death, or accident occurring during the charter or related travel

  • loss, theft, or damage to baggage or personal belongings

  • missed flights, missed connections, or transport delays

  • route changes, activity changes, or itinerary changes made by the Provider

  • service failures caused by third parties

  • losses arising from force majeure events

To the fullest extent permitted by law, where Boatique is found liable for any claim arising from its own booking and advisory services, its liability shall be limited to the amount of commission or service fee actually received by Boatique in relation to that booking, except where liability cannot legally be excluded.

Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.

Accuracy of Information

Boatique aims to ensure that all information, pricing, imagery, specifications, itineraries, and availability shown on the website or in proposals is accurate at the time of publication or issue. However, such information may change and may depend on details supplied by Providers.

Boatique reserves the right to correct errors, update information, revise pricing, or withdraw offers before a booking is confirmed.

Complaints

If you have a complaint during the charter, you must raise it as soon as reasonably possible with the captain, cruise director, or Provider so they have an opportunity to resolve it promptly.

If the matter is not resolved during the trip, you should notify Boatique in writing as soon as possible after the charter ends, including relevant details and supporting evidence.

Where the complaint relates to the delivery of the charter itself, Boatique may assist in liaising with the Provider, but the underlying responsibility for service delivery remains with the Provider where Boatique acted only as intermediary.

Website Use and Third-Party Services

Use of the Boatique website is at your own risk. The website may contain links to third-party services, payment providers, external booking tools, or external websites. Boatique is not responsible for the content, availability, privacy practices, or performance of third-party services.

Privacy

Any personal information collected by Boatique will be handled in accordance with our Privacy Policy. By making an enquiry or booking, you consent to the use of your information as reasonably required to arrange and manage your charter with relevant Providers and service partners.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws applicable to the Boatique contracting entity stated on your invoice or booking confirmation, unless mandatory consumer law provides otherwise.

Any dispute arising under these Terms shall be submitted to the courts having jurisdiction over that contracting entity, unless otherwise required by applicable law.

Changes to These Terms

Boatique may update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking unless a change is required by law or agreed in writing.
